I acknowledge that BLAZE Cycling, Yoga and Fitness is not responsible for safeguarding my personal belongings while I attend class. I am aware that the classes may be physically demanding and that by participating, I accept the risk of personal injury, property loss, or death. I agree that neither I, nor my heirs, assigns, or legal representatives, will hold BLAZE Cycling, Yoga and Fitness or its members liable for any injury, property damage/loss, or wrongful death, regardless of whether it is caused by negligence or other reasons.
In consideration of my enrollment as a yoga/fitness student with BLAZE Cycling, Yoga and Fitness (collectively referred to as "BCYF"), I affirm and agree to the following:
1. Health Certification: I have been examined by a licensed physician within the past six months and have been found to be in good physical health, fully capable of performing all exercises taught during my enrollment with BCYF.
2. Adherence to Instructions:I will faithfully follow all instructions provided by BCYF and its instructors regarding how to perform and avoid certain yoga and movement exercises. I understand that any deviation from these instructions is at my own risk.
3. Class Conditions: I understand that the yoga and movement classes will last between 45 to 90 minutes in a room heated to an average of 105°F with 40% humidity. These exercises include standing, kneeling, bending, lying prone in various postures, and stretching and compressing different body parts. I recognize that I am responsible for practicing yoga safely and for monitoring my condition at all times. I acknowledge that participation in these activities could lead to serious injury, including musculoskeletal, cardiac, neural injuries, stroke, heart attack, or even death.
4. Assumption of Risk: I accept all risks associated with participating in yoga and movement classes and will not hold BCYF, its officers, directors, instructors, or employees responsible for any injuries that occur due to my failure to follow instructions or disclose any physical impairments to BCYF in writing. Additionally, I agree to defend, indemnify, and hold BCYF and its affiliates harmless from any claims, lawsuits, or demands arising from my presence at BCYF premises or participation in any related activities, including yoga and movement classes.
5. Limitation of Liability: I understand that I am only receiving instruction in yoga theory and exercises, and I will not hold BCYF, its partners, instructors, or employees to a higher standard of care than that applicable to a yoga school.
6. Payment and Refund Policy: Payments for services are non-refundable. Any refunds granted are at the sole discretion of BCYF.
7. Contract Terms and Cancellation: I am entitled to a copy of this contract upon signing and may cancel it within three operating days. If canceled within this period, I am entitled to a full refund. If I need to cancel the contract due to death, permanent disability, or relocation, BCYF may retain a portion of the total contract price for services rendered, up to 25%. If I am a member of the U.S. military and deployed outside the state, I may cancel or suspend the contract by providing appropriate documentation.
8. Class Scheduling and Code of Conduct: BCYF retains the sole discretion to schedule yoga/fitness classes and instructors. Any changes in the schedule or instructors are not grounds for terminating the contract or requesting a refund. I agree to abide by BCYF’s code of etiquette, which is available in writing and on their website. BCYF reserves the right to change this code at any time without it being a reason for contract termination or refund.
9. Contract Assignment: I understand that I may not assign this contract to another party. The terms of this contract apply regardless of the class package purchased and remain effective through any renewal periods.
10. Governing Law and Disputes: This contract is governed by Arizona law, and any disputes will be heard in Maricopa County. In the event of legal action, I waive any claims to court costs or attorney’s fees.
11. COVID-19 Assumption of Risk: I acknowledge the risks associated with COVID-19 and agree not to visit or use BCYF facilities if I have symptoms, have been exposed to, or have been diagnosed with COVID-19. I assume all risks of attending BCYF during the pandemic, including potential exposure to COVID-19. I agree to hold BCYF harmless from any claims arising from such exposure, including legal fees.
Cancellation Policy
A 2-hour notice is required to cancel a class reservation. If I cancel within less than 2 hours before the class begins, a $15 fee will be charged to the payment method on file.
Purchase Policy
All sales are final—no refunds, extensions, or transfers on services. Products may be exchanged only if returned in their original condition.
PHOTO | VIDEO | AUDIO RELEASE
I authorize BLAZE Cycling, Yoga and Fitness, along with its agents and employees, to capture and utilize photographs, video footage, and audio recordings of me taken at the facility or event for use in all marketing, public relations, and advertising platforms associated with BLAZE Cycling, Yoga and Fitness. This includes electronic versions intended for distribution across various media channels, without further notice to me.
I waive any right to review or approve the final photographs, videos, audio recordings, or any printed or electronic materials that may incorporate them now or in the future, regardless of whether I am aware of their use. Additionally, I waive any claim to royalties or other compensation related to the use of these photographs, video footage, or audio recordings.
By signing this, I agree to release, defend, and hold harmless BLAZE Cycling, Yoga and Fitness, its agents, and employees, as well as any associated firms that may publish or distribute the final product, whether in print, electronic form, social media, or websites. This includes protection against any claims, damages, or liabilities that might arise from the use of the photographs, video footage, or audio recordings, including any potential misuse, distortion, alteration, or unintended effects that may occur during the creation, processing, publication, or distribution of the final product.
I affirm that I am at least 18 years old and fully competent to contract in my own name. I have read and understand the contents, meaning, and implications of this release. I acknowledge that I have the opportunity to ask questions about this release in writing before signing, and my failure to do so will be considered as a voluntary and informed acceptance of its terms.
